Used equipment that is deemed non-waste
Once equipment is deemed a non-waste, some actors argue that it then falls outside the scope of the Basel Convention which only regulates wastes. This issue is another iteration of the issue about the scope of the definition(s) used to categorize waste and non-waste.
Argentina argues that Criteria 3 [Ownership] inappropriately extends the regulatory scope of the Basel Convention to non-wastes. The reason behind Argentina's claim is that Criteria 3 addresses used equipment (non-waste) and waste (see Argentina's comments on Draft Technical Guidelines version of 20 November 2014).
