Governments should have interpretive flexibility on waste/non-waste
Governments should have some flexibility on determining the distinction between waste and non-waste electronics. Governments should be able to apply national legislation that decides whether electronic equipment exported for reuse are or are not subject to the Basel Convention.

“GEEP-TechProtect, while being concerned about the problem of illegal trans-boundary traffic of hazardous wastes and other wastes and fully recognizing that any State has the sovereign right to ban the entry or disposal of foreign hazardous wastes and other wastes in its territory, we are convinced that the trans-boundary movement of hazardous wastes and other wastes should be permitted when the transport and the ultimate disposal of such wastes is environmentally sound.”
