The HELP Separated Children Act will provide the following:

  • custody hearings
  • training to those who work in the State immigration agencies to take into account the best interest of the child, including a preference for family unity.
  • training of law enforcement agencies to minimize trauma to a child at the time of apprehension of parent or guardian.
  • ensure that case managers speak native language of children to ensure complete understanding and comfort-ability.
  • "require that, in all decisions and actions relating to the care, custody, and placement of a separated child, the best interest of such child, including a preference for family unity, be considered, and ensure that such decisions are based on clearly articulated factors that do not include predictions or conclusions about immigration status or pending Federal immigration proceedings;"   
  • preserve confidentiality of all parties involved. 
  • ensure that parents are given adequate time to obtain a passport and visa and to collect all important documents if they wish for their child to accompany them to their country of origin. 
  • ensure that detained parents and/or guardians:
                  - granted free and confidential phone calls 
                  - permitted regular visits with their children
                  - able to participate in all court proceedings that determine the custody of their children
                  - access to reunification programming or parenting classes
