Denying Same-sex couple the right to marry would violate the 14th Amendment's equal protection clause.

"No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States..." 
*Abridge in this case means the same as divest, or depriving some a power, right, or possession
